On June 30, 2010, we went into Toyota Universe on 1485 RT 46 in Little Falls, NJ looking to lease a new car. We were assisted by a new sales person by the name of Peter **. We test drove a new vehicle of our interest, spoke about terms with him as well as his manager, Max **. Max reviewed all information as well as credit report with us. Moments later, Max came back and advised us that we were approved for a lease with $** a month for 36 months and $600 down, which included the first month payment of vehicle. We then proceeded with a loan officer by the name of Shaun ** and finalized all paperwork needed. We added insurance on the vehicle, and they all urged us to take the car home that night.
On July 7, 2010, we received a call from the loan officer, Shaun, stating that bank saw a bankruptcy filing on my credit report so I educated Shaun that my mother with the same name has filed bankruptcy, not I. The next day, Peter ** called, requesting a letter confirmation that bankruptcy is under my mother's name, not mine, from the attorney. Once I got the documents, I sent a fax confirming the bankruptcy information. That same day, I received a call from Peter stating that they received fax and that the bankruptcy issue with the bank was resolved. But that car needed to be returned because the dealership overlooked the price of the car and the car was undersold to us. I advised Peter to give a call within an hour so I can communicate with Ruben and get more understanding of situation.
No later than 15 minutes, Mr. Shaun **, the loan officer who worked out our contract, called me and demanded that the car to be returned. He specifically stated that the car was undersold for $3,000 and that the owner wasn't going to take the loss. When I tried to explain my defense, Shaun interrupted and basically blackmailed me so they won't proceed with the approval until we agree to another vehicle that doesn't include the additional items our vehicle has (rims and DVD player).
He attempted to persuade us in lower payments with another same model vehicle. He wouldn't allow me to speak in our defense. He continued to say that we tried to get over on a salesperson because he was new, when we, as customers and first time buyers, do not have the knowledge of car's pricing. Then, he called us thieves stating that he will be cancelling the temporary plates on the car and would report the car as stolen.
Within a few days, we reviewed our contract and paperwork, as well as consulted advice from colleagues and lawyer that is willing to represent our case. On July 13, 2010, Ruben received calls from Shaun with threats and demands of car being returned. Shaun stated that the bank loan was approved but he wouldn't get it approved because we didn't comply with his demands. Ruben requested written letters to be sent to us, as well as harassment calls suppressed. Shaun stated that he wasn't sending anything in writing, he was giving us a verbal request and that he was going to get the car repossessed. He also made statements like, "Bring me back my car, you are acting ludicrous!"
In conclusion, we want to file a legal complaint against Toyota Inc, Toyota Universe, and also Shaun **. We have our contract and paperwork signed. We have copies of bankruptcy information, copies of my credit report not showing bankruptcy listed, phone bill with time and dates that we have been called from the dealership. Toyota has discriminated, blackmailed, and disrespected us as humans and we are willing to take all additional steps to have this matter escalated to the highest point possible.
